What is a Vidclose?

A Vidclose happens when all closing documents in a settlement are signed and notarized via online video conferencing. No in-person signing is required.

What is a hybrid Vidclose?

A hybrid Vidclose allows for key documents such as a promissory note and deed of trust to be “wet signed” in person (pen and paper) with a settlement agent present at your location, while the rest are signed electronically.

Who cannot close use Vidclose?

Someone whose bank or lender won’t allow it.

What is RON (Remote Online Notarization)?

It’s the concept that a notary can be online, can legally confirm your identity and act as a witness for your real estate closing.

Why won’t some banks allow a closing by Vidclose?

Some banks and lenders need to make sure they can, if necessary, still be able to foreclose on a property that was purchased or sold using digital signatures. Some banks are comfortable with it and some are not. The good news is that with time, all banks will have to determine how to do this.

Why are Online Notarized Closings legal in Florida?

On Jan 1st, 2020 it became law in Florida to allow digital notarization for a real estate closings. Now we are waiting to find out which banks will allow it. For all cash closings it is legal to close using this new method.

What is the difference between Electronic Notarization and Remote Notarization?

There is a difference between eNotarization and remote notarization. The first, eNotarization, allows documents to be signed and notarized digitally BUT also requires the signer to physically be in the same room as the notary. The second, remote notarization, allows documents to be signed and notarized digitally but WITHOUT the requirement of being in the same room, state, or sometimes even the same country.

What is the UETA?

The Uniform Electronic Transactions Act (UETA) is what made it possible to use electronic signatures and to store financial documents in digital format instead of requiring traditional wet signatures on paper. This was the first act that took place to get one step closer to making eClosing and eRecording a reality. There are other state and federal laws that play a part as well, including the “full faith and credit” clause from the US Constitution, the federal ESIGN Act and other state statutes support eNotarization and remote notarization.

There are 2 important principals these laws establish:

  1. Authorization is given to notaries to eNotarize documents with eSignatures, done in the presence of the notary (not remotely)
  2. When completed according to the law of one state, a notary act completed in that state will be recognized as valid in another state, even if those two states have different or conflicting regulations and rules.

If I’m a Foreign National, can I use this service?

Not yet, you need a US Social Security number. The social security number is used to prevent fraud, and questions are asked specifically about your credit history.

If I’m out of the USA, but have a social security number, can I use this service?

Yes, you can, as long as you have social security number and we can verify it’s you, all you need is a dependable internet connection.

How do you validate my ID?

Based on your social security number, certain questions will be asked according to your credit history. You will have to correctly answer the questions as part of the process of correctly identifying who you are. Kind of like those common security questions you have to answer like, “What year, make, and model car have you owned or currently own?” and then you’re given 4 choices.

Can the Realtor be present during the Vidclose?

Yes, the realtor can be present. They will have their own login and video screen with the ability to talk.

What Lenders will allow Vidclose?

We anticipate that by the summer of 2020, most lenders will be on board with this. We recommend that you ask your lender what their time frame is.
